Welcome to APRNJobs.org (the “Site”). These Terms and Conditions (“Terms”) govern your access to and use of the Site, including all content, features, job board services, employer listings, resume submissions, communications, and related offerings provided by Ventures of Bird, LLC (“Company,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to be legally bound by these Terms. If you do not agree, you must not access or use the Site.
1. Eligibility and Intended Use
You must be at least 18 years old or the age of legal majority in your jurisdiction, whichever is higher, to use the Site.
The Site is intended solely for individuals seeking employment opportunities and for employers or recruiters seeking candidates. Use of the Site for unauthorized commercial purposes, competitive intelligence, scraping, resale, or similar activities is prohibited.
2. User Accounts and Responsibilities
Certain features require account registration. You are responsible for safeguarding your login credentials and for all activity conducted under your account, whether authorized by you or not.
You agree to provide accurate, current, and complete information and to keep your account information updated. You may not impersonate another person or misrepresent your affiliation with an employer, institution, or organization.
We reserve the right to suspend or terminate accounts that contain false, misleading, incomplete, or unlawful information, or that otherwise violate these Terms.
3. Job Postings, Resumes, and User Content
Employers and recruiters may submit job postings. By doing so, you represent that the posting is accurate, lawful, non-misleading, and compliant with all applicable employment, advertising, and anti-discrimination laws, and that you have the authority to post the position.
Job seekers may upload resumes, cover letters, and related materials. By submitting content, you grant the Company a non-exclusive, worldwide, royalty-free license to host, store, display, transmit, and reproduce that content solely for purposes of operating and providing the Site and its services.
The Company does not guarantee job placement, hiring outcomes, or candidate suitability. We do not verify employer legitimacy or user qualifications and are not responsible for inaccuracies in postings or submissions.
4. Acceptable Use and Prohibited Conduct
You agree not to use the Site to post or transmit unlawful, defamatory, abusive, obscene, fraudulent, or misleading content, or to engage in harassment, phishing, spamming, or deceptive practices.
You may not use automated tools, bots, scrapers, or data-mining technologies to access or interact with the Site without prior written authorization.
You must comply with all applicable laws and regulations when using the Site. Violations may result in content removal, account suspension or termination, and legal action where appropriate.
5. Intellectual Property
All Site content, including text, software, graphics, logos, icons, and design elements, is owned by the Company or its licensors and is protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Site for its intended purposes. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Site or its content without express written permission.
6. Paid Services, Billing, and Fees
Certain features may require payment. Pricing, billing terms, and subscription details are disclosed at the point of purchase.
You authorize the Company to charge the payment method you provide for applicable fees. Unless otherwise required by law, fees are non-refundable.
We reserve the right to change pricing or service offerings with advance notice where required.
7. Third-Party Services and Links
The Site may include links to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices.
Your interactions with third parties are solely between you and the third party. The Company disclaims liability for losses or damages arising from third-party services.
8. Disclaimers
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant uninterrupted operation, error-free functionality, or that the Site will meet your expectations or requirements.
9. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Site.
Where liability cannot be excluded, it is limited to the amount paid by you to the Company in the twelve months preceding the event giving rise to the claim.

10. Indemnification

Upon termination, all licenses granted to you immediately cease.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles.
Except where prohibited by law, disputes arising out of these Terms shall be resolved through binding arbitration conducted on an individual basis. You waive any right to participate in class actions or class arbitrations.
Nothing in this section limits your statutory consumer rights under applicable law.
13. Privacy and Data Protection
Your use of the Site is subject to our Privacy Policy, which explains how we collect, use, and protect personal data. The Privacy Policy is incorporated into these Terms by reference.
14. Job Posting Standards
Job postings must comply with all applicable employment, labor, and anti-discrimination laws. Postings may not promote illegal activities, pyramid schemes, franchise sales, or opportunities requiring upfront investment unrelated to employment.
We reserve the right to edit, reject, or remove postings at our discretion.
15. No Employment Agency Relationship
The Company does not act as an employment agency or broker. We provide a platform to facilitate connections between job seekers and employers and do not endorse, vet, or guarantee either party.
16. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, governmental actions, labor disruptions, or infrastructure failures.
17. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
18. Entire Agreement and Waiver
These Terms constitute the entire agreement between you and the Company regarding the Site. Failure to enforce any provision does not constitute a waiver of that provision.
19. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, sale, or restructuring.
20. Feedback
Feedback or suggestions you submit may be used by the Company without obligation or compensation, and you grant us a perpetual, worldwide license to do so.
